Actors against Netflix, Artisti 7607 takes the streaming giant to court

Artisti 7607, the cooperative society that protects and manages the related rights of thousands of actors and voice actors in Italy and around the world, has sued Netflix at the Civil Court of Rome to «obtain the adequate and proportionate compensation due by law to its mandating artists ». After «over eight years of sterile negotiations to obtain the data necessary to determine the compensation for artists provided for by European and national legislation – we read in the collecting cooperative’s press release – Artisti 7607 is forced to appeal to the ordinary judge to request compliance of the law.”

Several of the artists represented by the cooperative spoke out in support of the decision to take Netflix to court. «Artisti 7607 makes a necessary choice to defend the professional dignity not only of our artists but of the entire category. We do not want to suffer obstructionist attitudes and accept negligible compensation from streaming platforms, for the same reasons that motivated the recent strike of American actors and screenwriters. We all demand transparency of the data on the exploitation of audiovisual works and adequacy of the compensation”, said Neri Marcorè.

«These payments effectively constitute the deferred salary of a profession that is by its nature occasional and precarious. The rights associated with copyright are nothing more than a credit from work. This push to devalue the artistic performances of performers is very serious and dangerous”, underlined Carmen Giardina. «The very platforms that process and exploit data refuse, thanks to their excessive economic and contractual power, to provide us with the data required by law and to consequently pay the fees to the artists. And we are talking about multinationals whose revenues come exclusively from the exploitation of audiovisual works”, declared Elio Germano.

«The Copyright Directive has clarified that artists’ remuneration must be “adequate and proportionate” to revenues. Instead we find ourselves faced with a system in which the platforms, without providing all the information required by law, close deals at a low price and then try to impose the same figures on the entire market, so as to keep the artists’ compensation levels always very low. », added Michele Riondino.

«In this way Artisti 7607, to protect the interests of the artists, is forced to delay the collection and distribution times of both the fair compensation and the private copy, also to the detriment of initiatives to support the category. We have been facing downward market practices for some time but, by holding firm positions in everyone’s interest, we have managed to obtain the right remuneration. Many artists understand what we are doing and continue to choose us”, underlined the president Cinzia Mascoli.
