AGC returns Mohd Shuhaily investigation paper to police for CCTV verification

The Attorney General’s Chambers has returned the investigation paper concerning the Border Control and Protection Agency Malaysia to the Royal Malaysia Police, directing investigators to obtain a formal statement from Director-General Datuk Seri Mohd Shuhaily Mohd Zain and verify closed-circuit television footage related to an alleged incident at Kuala Lumpur International Airport.

Attorney General Tan Sri Mohd Dusuki Mokhtar confirmed that the case file was handed back to the police on Thursday. He explained that several procedural aspects require further attention before any final decisions are made regarding the high-profile inquiry into the security agency chief.

“The police need to obtain a statement from the AKPS Director-General, verify the authenticity of the CCTV footage, and address several relevant matters to complete the investigation,” the Attorney General said when contacted by Sinar Harian on Thursday, noting that the file was returned to law enforcement the same day.

Police Submit Investigation Papers on KLIA Altercation

The Royal Malaysia Police had originally submitted the completed investigation papers to the Attorney General’s Chambers on Tuesday. Inspector-General of Police Tan Sri Mohd Khalid Ismail previously stated that the dossier was forwarded for legal review, strategic advice, and subsequent directives pursuant to Article 145(3) of the Federal Constitution.

The controversy stems from an alleged altercation at KLIA Terminal 1 on September 28. Two police officers filed official reports claiming they were physically manhandled by the Border Control and Protection Agency chief during the incident. Authorities registered the case under Section 323 of the Penal Code, which addresses voluntarily causing hurt.

Investigators Record Statements from 25 Witnesses

As part of the ongoing fact-finding process, investigators have recorded statements from 25 witnesses. The interviewed individuals span multiple agencies and organizations, including Royal Malaysia Police officers and rank-and-file personnel, Border Control and Protection Agency officials, Malaysia Airports Holdings Berhad auxiliary police, baggage handling personnel, medical officers, and independent eyewitnesses.

Prior to the return of the case files, Datuk Seri Mohd Shuhaily Mohd Zain publicly stated his readiness to accept any decision or administrative action taken by the government following the circulation of the video footage linked to the airport dispute.
