BaFin warns of fraudulent gold investments via WhatsApp

German financial regulator BaFin has issued an urgent warning regarding fraudulent gold-investment schemes operating through WhatsApp groups, utilizing a fictional market strategist named Albrecht Reimund Hohenacker to lure victims toward the unregulated trading platform elyrion-wealth.com and associated mobile applications.

The WhatsApp Trap and Fictional Strategist Persona

Investors across Germany are being targeted in messaging applications by an individual introducing himself as Albrecht Reimund Hohenacker, who claims to be a financial market strategist and capital market researcher. According to BaFin’s official advisory, Albrecht Reimund Hohenacker is a fictitious character. The bad actors behind the scheme use the persona to pitch high-yield investment programs centered around gold-market-based financial instruments.

Victims are directed away from standard brokerage channels and onto the online trading platform elyrion-wealth.com, operated by an entity styling itself as ELYRION WEALTH LLC in the United States. Targets are further instructed to download custom applications titled “ELYRION WEALTH” or “ELYRIONW” from major mobile app stores to manage their funds. BaFin notes that the mere presence of an application in a recognized software repository provides no validation of an enterprise’s legitimacy or regulatory standing.

Regulatory Violations and Unlicensed Operations

Neither the operators of the WhatsApp networks nor the entities behind the website and mobile applications possess authorization from BaFin. Under section 37 paragraph 4 of the German Banking Act (KWG), any institution or individual providing financial or securities services within Germany requires explicit regulatory approval. The regulator confirms that no licensed institution is currently authorized to solicit German retail investors via messaging applications.

The operational pattern mirrors classic boiler-room tactics deployed via modern social media vectors. Trading software interfaces display artificial gains that exist solely on the screen. When investors attempt to execute a withdrawal, transactions are blocked or conditioned upon successive demands for additional fees, taxes, or security deposits. Pressure mounts continuously from group administrators and purported assistants demanding further capital injections, while sensitive documentation such as identity cards and bank account details handed over during onboarding risks being weaponized for secondary financial crimes.

Immediate Countermeasures and Legal Defense

Legal experts advise affected individuals to immediately sever all contact with the fraudulent groups and halt any further capital transfers, regardless of promises that a final fee will unlock trapped funds. Essential preservation steps include securing all chat histories, phone numbers, platform screenshots, bank statements, and wire transfer receipts.

Victims should immediately notify their banking institutions to explore whether recent transactions can be intercepted or recalled. Security protocols dictate that remote access software must never be granted to smartphones or personal computers, and no further identification documents or access credentials should be disclosed.

Dr. Späth & Partner Rechtsanwälte mbB, a law firm specializing in banking and capital market law since 2002, is handling inquiries from affected investors. Christian-Albrecht Kurdum, a lawyer at the firm, offers a complimentary initial assessment to evaluate legal options. Filing a standard criminal complaint with law enforcement rarely suffices to recover lost capital; targeted civil litigation is frequently required to pursue claims against operators, account holders, and involved financial institutions. The firm also assists clients in filing complimentary coverage requests with personal legal protection insurance policies to verify cost assumptions.
