Court Case: Man Acquitted of Child Exploitation Charges in Appeals Court

A man in his 20s who was put on trial on charges of downloading and storing sexual exploitation of children and teenagers from an overseas Internet file storage site was acquitted in the appeals court.

On the 24th, the Ulsan District Court’s Criminal Appeal Division 1-3 (Chief Judge Bong-su Lee) announced that it had found Mr. A, a college student indicted on charges of violating the Act on Sexual Protection of Children and Adolescents, not guilty, as in the original trial.

Mr. A has been on trial on charges of downloading and storing 31 pieces of sexually exploitative material featuring children and adolescents after signing up for an Internet file storage site on his cell phone at home in March 2019. At the time, it was reported that the total amount of pornography downloaded by Mr. A from the site was 400 gigabytes.

During the trial, Mr. A claimed that he only downloaded adult pornography and did not know that it contained child sexual exploitation material. She also claimed that when she downloaded pornography from the Internet file storage site, she was unable to distinguish between child sexual exploitation material because the file name was a sequence of letters and numbers.

The first trial court found Mr. A not guilty, citing the fact that child sexual exploitation material only accounted for 0.08% of the total pornography downloaded by Mr. A, and that it was automatically deleted during the subsequent storage process.

The appellate court also found Mr. A not guilty, saying that he could not rule out the possibility that he downloaded 400 gigabytes of pornography and did not know that only a small portion of it contained child sexual exploitation material.
