EU starts investigating Apple, Google and Meta for violating Digital Markets Law

A European Commission announced this Monday (25) that it is investigating Apple for possible violations of the Digital Markets Act. In fact, Apple is not the only target of this action, which also targets Alphabet (Google) and Meta.

The commission highlighted “Alphabet’s rules on driving on Google Play and self-preference on Google Search”, “Apple’s rules about driving in the App Store and the choice screen for Safari” and the “payment or consent model” yes Meta.

In general, the Commission wants “assess whether measures implemented by Alphabet and Apple in relation to their app store obligations violate the DMA” and also claims to suspect “that the measures implemented by these gatekeepers fall short of effectively fulfilling their obligations under the DMA”.

Concern was also mentioned about the possibility that the measures adopted by Apple may not be fully compatible due to the imposition of restrictions and limitations. In other words, it could reduce the ability of developers to “freely communicate and promote offers and enter into contracts directly, including by imposing various fees”

It is worth remembering that the European Commission even launched “investigative steps” about recent fees that Apple has implemented for the use of alternative app stores. Therefore, this may include the Core Technology Feewhich deals with a 50 cent charge for each first annual install of an app after the first million for providers of these platforms.

Thierry Breton, head of the Commission’s EU sector, said the investigations should not be treated as a surprise. When talking about Meta, he said it should offer free alternatives to its ad-free subscription service. In response, a company spokesperson said it strives to comply with the law’s guidance.
