The Government published in El Peruano the regulations that allow the return of money to former contributors to the National Housing Fund (Fonavi). WHAT DOES THE REGULATION SAY ABOUT THE RETURN OF FONAVI?

The measure was made official through Supreme Decree No. 280-2023-EF, published this Thursday in the Legal Standards Bulletin of the Official Gazette El Peruano.

The purpose of this rule is to achieve order in the procedures that govern the return of contributions to Fonavi; implement administrative simplification measures and the optimization of the aforementioned procedures, in relation to the registration and payment to bereaved of deceased Fonavis, as well as the administration of assets owned by Fonavi, among others.

WHAT IS FONAVI

FONAVI, also known as the National Housing Fund, is a fund of the Peruvian Republic created by Decree Law No. 22591, on June 30, 1979 by the government of Francisco Morales Bermúdez, which sought to finance loans so that the people can build or acquire homes. It was in force from June 1, 1979 until its dissolution on August 31, 1998.

This fund provided benefits to citizens who contributed monthly, which was not a tax. Between 1985 and 1992, 13 billion soles were collected, between 1992 and 1998, 6 billion were collected. The figures prior to those dates could not be calculated due to a fire that occurred at the Banco de la Nación in 2000, in which several documents were lost. This money was used for electrical construction.

In 1998 it was renamed the Extraordinary Solidarity Tax and in 2004 this fund was repealed due to irregularities in its figures.

In 2008, the Presidency of the Council of Ministers created the multisector commission to investigate what happened to the FONAVI money. It was estimated that the money missing between 1979 and 1998 reached 10 billion soles.

Many Fonavistas came out to demand the return of their money, which, due to legal bases, had to be returned if it was used for other purposes.
