Indert initiates judicial process to recover Chaco lands

Asunción, IP Agency.- The National Institute of Rural and Land Development (Indert) announced that this Wednesday it will begin the judicial process to recover some 19 lots in Chaco in favor of the State.

“The waiting period has been met and on Wednesday the 7th we will initiate the judicial complaint to recover Chacho lands in favor of Indert,” said the president of the institution, Francisco Ruiz Díaz, after waiting a few days for those who stopped paying the dues of the properties that have been awarded to them.

There are 19 lots of 3,000 to 4,000 hectares in area, which will return to the hands of Indert because they are in default (Art. 30 of Law 2419/04). In total there were 26 and of which the owners of seven properties were up to date with the payment of the fees, according to the institution.

The total amount owed to Indert by the awardees amounted to 23 billion guaraníes, of which more than 18 billion guaraníes correspond to the arrears in the payment of the installments and 4.958 million guaraníes to the non-payment of the delivery of the installment.

Last week, the agrarian entity managed to collect arrears on seven lots for the sum of 3,200 million guaraníes, thus reducing the amount in arrears to less than 20,000 million guaraníes.

The decision of the rural entity is based on article 53 of the Agrarian Statute, which establishes that the delay for three consecutive years causes the award to decline and the lot becomes available to the institution again, as explained by the legal director of the institution María del Carmen Cardozo.

Likewise, article 93 on non-compliance or illegal acts determines that non-compliance with legal obligations reverts the lots to Indert’s disposal when: a) Non-compliance with legal obligations is observed, and b) there is no economic and rational use of the lot. property for a period of more than two years.

Likewise, titled properties that have pending payment obligations are subject to the same legal provisions.

Likewise, the Agrarian Statute establishes that the method of compensation in payment rations that is intended to be imposed on the Institution is not a figure established in the Law and dangerously compromises the resources necessary to carry out the agrarian reform.

As a result of this background, this Wednesday, February 7, the procedures for the recovery of properties will resume, identifying, in this first phase of the year 2024, all cases of non-compliance linked to the Western Region or Chaco.
