Kim Oh-soo asks for a meeting with the president… “The deprivation of investigative power is unconstitutional”

Prosecutor General Oh-su Kim said that he had requested a meeting with President Moon Jae-in in relation to the so-called ‘examination and overhaul’ bill being promoted by the Democratic Party of Korea.

One day after the Democratic Party’s adoption of the party’s scrutiny, the incumbent chief prosecutor expressed his first resignation, and there was also a proposal to hold a general review and prosecutor’s meeting.

Prosecutor General Oh-su Kim requested an interview with President Moon Jae-in regarding the so-called ‘check-and-run’, the abolition of the prosecution’s direct investigation function adopted by the Democratic Party of Korea as its party argument.

“I asked the president for an interview regarding the bill to completely abolish the prosecutor’s investigation function, which was confirmed by the ruling party, the Democratic Party, in relation to the current issue.”

On the way to work, President Kim said, “I will stop the inspection with the determination to die immediately,” and insisted that “a bill that monopolizes criminal investigations to the police is a direct violation of the Constitution.”

As controversy arose over these “unconstitutional” remarks, President Kim volunteered to hold a press conference for the first time since taking office and reiterated the prosecution’s position.

President Kim argued, “The Constitution stipulates the prosecutor’s right to request a warrant, but requesting a warrant means ‘compulsory investigation’, and it is unconstitutional to take away the investigative authority from the prosecutor.”

He added, “The entire criminal justice system was completely reorganized a year ago and the entire legal world is in chaos.

On the other hand, one day after the Democratic Party adopted the ‘check-and-run’ bill as its party argument, for the first time, the incumbent chief prosecutor resigned.

Prosecutor Lee Bok-hyeon, 2nd Criminal Division Chief of the Seoul Northern District Prosecutors’ Office, posted a message on the prosecution’s internal network saying, “If the prosecution’s investigation authority is removed, it will cause disturbances in the financial and stock markets for the time being, disturbances in the market order of large corporations, and interference by the highest-ranking powers. The investigation into Korea will disappear.”

Prosecutors of the Daejeon District Prosecutors’ Office posted a message on the prosecution’s internal network and suggested holding a meeting of all prosecutors, such as the general prosecutor’s meeting, where all prosecutors gathered during the past prosecution.
