Is it constitutional to declare public spaces intangible to avoid protests?

After the municipality of the capital published the norm that established the historic center as an intangible zone, various specialists have ruled on whether this measure would be unconstitutional.

In conversation with La República, Heber Joel Campos, professor of constitutional law at the PUCPexplained that there is a precedent where the TC did not allow a similar rule to be applied (STC No. 04677-2004-AA) because it affected the democratic principle and the rights linked to the protest.

“What he said TC It is that this collided with the right to freedom of assembly, with the right to freedom of expression and with the right to protest. We can all demonstrate in public spaces respecting order, not endangering the integrity of third parties or going against public or private property, ”he clarified.

In this sense, Campos affirmed that this decision of the Municipality of Lima “seeks to limit this right, which could clash with the Constitution.”
