Migration: Government withdrew decree that established new requirements to qualify for temporary residence

The Ministry of Interior withdrew from the Comptroller General of the Republic the supreme decree that established the migratory subcategories of temporary residence -of new visas- pertaining to the new Migration Law presented by former President Sebastián Piñera.

As stated The Mercurythe document has already been withdrawn by the Ministry and must be re-entered so that The Comptroller’s Office makes the decision and the decree enters into force, according to the National Migration Service (SNM).

The new regulation detailed that foreigners who had entered the country through authorized steps before March 18, 2020and who were in an irregular migratory situation, could -within 180 days from the publication of this new law- apply for a temporary residence visa without being penalized.

On the other hand, the norm indicated that those who had entered after March 18 of last year on a regular basis and that due to the closure of borders due to the Covid-19 pandemic, your visa has expired, they should pay a fine digitally and request a new document.

I think this is a very bad sign, especially at this time when we are facing a serious migration crisis in the north. and we need this new legislation operating fully to try to order what is happening,” lashed senator Ebensperger light (UDI).

“The government, basically, with the withdrawal of this decree that established the new migratory subcategoriesis trying to make this new law fail – warned the legislator – in some way, is bending the hand of Congress, because when they were part of Parliament they did not have the necessary votes to reject these regulations and approve the ones they wantedtoday that they are Government they are using their faculties to turn it into a dead letter”.
