There has been repeated speculation that the National Council election, which normally takes place at the end of September, could be brought forward to June 9th, the day of the EU elections. The corresponding time window, which would have allowed an advance according to the deadline, has now finally closed this week. Ultimately, the “deadline date” would fall on March 19th – and there is now too little time for the procedure to be carried out until election day is announced in the Federal Law Gazette at least one day before.

In order to bring it forward, a new election request from the National Council would first be necessary. After the corresponding decision, which can also be made in a special session, it must be assigned to the Constitutional Committee and dealt with there. Then he goes back to the plenary session.

The following legal deadline then applies to setting the election date: According to the National Council election regulations, there must be 82 days between the deadline to be fixed with the announcement of the election, from which various deadlines begin to run, and the election, which is what a vote on June 9th is March 19th would be. In addition, the election must be advertised in the Federal Law Gazette at least one day beforehand.

The regulation then goes to the main committee, which must confirm the date with a parliamentary majority. Finally, the Federal President is asked to make the election public by announcing it in the Federal Law Gazette. The process can take at least one, if not several, weeks, depending on National Council and government meetings and the approval of the Federal President.

Various deadlines begin to run from the deadline, such as those for appointing the district returning officers, the assessors and the constitution of the electoral authorities. But he also determines various requirements for the right to vote, eligibility or the collection of declarations of support from the smaller parties. And the election campaign cost cap also begins to take effect from this day onwards.
