The Chelyabinsk Electrometallurgical Plant (CHEMK) Controversy: Confiscation of Shares and Nationalization Updates

The Arbitration Court of the Sverdlovsk Region satisfied the claim of the Prosecutor General’s Office of the Russian Federation to confiscate shares from the owners of three industrial enterprises of the Chelyabinsk Electrometallurgical Plant (CHEMK). The corresponding decision reports Interfax with reference to the file of arbitration cases, it was issued on February 26. The court hearing was held behind closed doors.

As part of the lawsuit, the Prosecutor General’s Office demanded the seizure of the shares of the Serov Ferroalloy Plant, the Chelyabinsk Electrometallurgical Plant and the Kuznetsk Ferroalloy Plant belonging to the Etalon company of Yuri and Lyudmila Antipov.

The supervisory authority announced that the privatization of enterprises in the 1990s was carried out with violations and, therefore, the Antipovs took possession of the shares illegally. In addition, according to the claim filed by the Prosecutor General’s Office, in February 2023, the assets of the factories were registered in the name of the Etalon company and came “under the control of residents of unfriendly states.”

The enterprises of the ChEMK group are the country’s largest producers of ferroalloys used in the production of steel for military equipment, aircraft engines and ammunition.

In April 2023, Putin signed a decree allowing the assets of foreign companies in Russia to be transferred into “temporary management”—that is, in essence, to nationalize them. This is how the owners of the Russian assets of the brewing company Carlsberg and the dairy products manufacturer Danone changed. In December, the Rolf company, one of the largest car dealers in Russia, was nationalized under the same scheme. This marked the first time that a scheme designed to nationalize the assets of “unfriendly” countries was applied to a company created by a Russian businessman.
