A medical certificate may no longer be required to take leave to care for a sick child. This is the meaning of an amendment voted on last week by senators as part of the proposed law on access to care, reports Capital. Wise people want a simple sworn statement to be enough to stay at home with your child. To support their measure, the senators put forward “the expectations of doctors in terms of reducing unnecessary medical certificates”.

Agnès Giannotti, president of the MG France union, which brings together a majority of general practitioners, agrees: “We have been asking for this for a long time”. This time spent establishing certificates has been quantified. On average, GPs take between one and a half and two hours per week to produce certificates of all kinds.

A compromise to be found between parliamentarians

“We often have the case of a child who has gastro or a slight temperature and cannot go to daycare. Parents could very well treat them themselves but request a consultation in order to have this medical certificate to give to their employer. We are walking on our heads,” explains Luc Duquesnel, president of the general practitioners’ section of the Confederation of French Medical Unions (CSMF), to our colleagues. However, Jérôme Marty, general practitioner in Haute-Garonne and president of the French Union for Free Medicine (UFML), judges that the amendment is unsuitable and “reflects a lack of knowledge of the field”.

The measure could also be contested within the ranks of employers, and which could also damage the relationship between the boss and his employee. “The employer can more easily have doubts, more doors open to suspicion about the legitimacy of the absence,” recognizes a lawyer specializing in labor law. The Valletoux bill, in which this amendment should appear, must now be the subject of a joint joint committee with the deputies.
