The Supreme confirms 12 years in prison for abuses to the former director of the children’s choir of the Community of Madrid

The Supreme Court has confirmed a sentence of 12 years in prison for the director of the Children and Youth Choir of the Community of Madrid, in which dozens of minors participate and at the head of which he was between 2015 and 2017. Justice has declared in this process that DDG, the convicted person, abused the underage student for months, manipulated the victim until He broke ties with his family and friends and, in short, achieved the “depersonalization” of the minor. The Madrid judges explained how in the process the young woman reported “a stark situation of sexual abuse and manipulation, psychological violence and objectification.”

The different sentences of the case reveal that the then director of this Choir, dependent on the Ministry of Education, Culture and Sport of the Community of Madrid, began to abuse this minor in November 2016, a young woman whom he had also selected to be part of the Chamber Choir that he also directed by appointment of the regional government. Sexual abuse and humiliation that, according to the Madrid courts, “took place in conditions that led to a depersonalization” of the victim. If she complained about the sexual practices that the pedophile put into practice, he replied that she was “weird”. He always knew how old she was, among other things because of her presence in a children’s choir that he directed.

The director of the Choir, according to the sentences of the case, “manipulated the victim and subjected her to an early interpersonal abusive situation continuously (from 14 to 17 years old), in such a way that it made her break the relationship of trust that he had with his parents and it isolated him from his relationship with friends and classmates his age and made it difficult for him to carry out his daily activities”. A total control over a minor that resulted in depression and “personality breakdown” to the point of having suicidal thoughts, with consequences that the victim suffers to this day.

The parents filed a complaint for these facts in February 2017, when they learned what the director of the Choir was doing with their daughter, the year in which DDG stopped directing the Choir of the Community of Madrid, although no reference was made from the Regional Government or from the Ministry that directed then Raphael of Greeks. This pedophile has also directed other choirs in the Community of Madrid in the last decade.

In his different appeals, which failed first before the High Court of Justice of Madrid and now also before the Supreme Court, the former director of the Children’s Choir has contested the amount recognized as compensation of 22,000 euros for the victim, or has questioned that it did not mitigating factors of undue delays are applied for the time in which the process took to be sentenced. “In the present case, the existence of non-pecuniary damage is clear and the psychological suffering experienced as a result of the facts as well,” said the TSJM, for example, in the second instance.

The Supreme Court, in a sentence that this newspaper has been able to examine, has ratified his sentence of 12 years in prison for crimes of sexual abuse and also against moral integrity. A process in which the courts have also verified the process of double victimization to which the victim was subjected: “His participation in the trial necessarily determines elements of re-victimization, especially because in his successive statements he has had to re-experience the facts “, Said, for example, the Court of Madrid. The judges have also highlighted that the director of the Choir had the “duty to take care of her, help her and guide her” and he did not.

The psychologists of the Unit for the Attention of Adolescent Victims of Gender Violence explained during the trial that this was “a case of serious psychological and sexual violence, experienced from an early age, for a long time and by a person close to them and trusted, with the vulnerability that this causes”. They also added that “suffering violence with these types of characteristics can cause a serious emotional imprint”, as has happened in this case.
