A case in mainland China in which “a man sneaked into a female classmate’s home with a knife and stabbed three people without being punished, and seven months later drove his car to death of the female classmate’s mother and son” has attracted widespread attention and has made important progress recently. In July this year, the murderer Zhou Nan was executed; the verdict was announced recently in the case of the deceased’s family suing the Shuangfeng County Public Security Bureau of Hunan Province. After Ms. Peng was discharged from the hospital, she called the police handling the case many times and requested that Mr. Zhou be detained. The police first said that they could not detain Mr. Zhou due to the epidemic, and later said that his behavior did not constitute a criminal case. On October 12, 2020, Zhou Nan drove a rented car near Ms. Peng’s home. When he saw the man taking his niece and son out, he immediately stepped on the accelerator and crashed into three people, killing Ms. Peng and her son. The 12-year-old niece was injured and hospitalized. .
On May 25, 2021, the Loudi Intermediate Court sentenced Zhou Nan to death for intentional homicide in the first instance. With the approval of the Supreme People’s Court, Zhou Nan was taken to the execution ground and executed by firing squad on July 7 this year. On the other hand, after the murder of Peng Nu and her son, the family members began to report the problems of the investigators to relevant departments. They believed that if the police had taken coercive measures against Zhou Nan at that time, the two people would not have been killed. They decided to take the Shuangfeng County Public Security Bureau to court. .
The Lianyuan City Court recently issued a verdict, revoking the “Administrative Compensation Decision” made by the Shuangfeng County Public Security Bureau on August 3, 2021; confirming the defendant’s handling of Zhou Nan’s illegal behavior on April 5, 2020, and his handling of the violation on February 2, 2020. The handling of illegal acts on March 26 since March 27, 2020, and the failure to perform statutory administrative duties in a timely manner in accordance with the law is illegal; the defendant is ordered to compensate the plaintiff for various losses totaling RMB 820,000 (approximately NT$3.63 million). However, the family of the deceased is not satisfied with the verdict and has appealed.
