On December 19, the 75-year-old mother was admitted to hospital following a worsening of her state of health over the days. In a state of confusion, the septuagenarian is no longer able to speak and is hospitalized in room number 16 of the emergency corridor.
Opposite his room, at number 14, Bernard joins the emergencies in turn in the evening. The latter, under the influence of the drink, was just before picked up by a passerby after falling to the ground. All this, just a few days after the 30-year-old man was released from prison.

For the first time, there is concern about Bernard’s behavior. The latter has just been arrested by a young nurse walking down the hallway of the pediatric ward of the hospital and entering two rooms. The security service is alerted and everyone thinks that Bernard will wisely return to his room.
But a few moments later, a witness discovers Bernard, his pants down in an unequivocal position on the septuagenarian in room number 16. The latter has her blouse up to her neck, her diaper on the floor torn off by her attacker. Half conscious, the patient has just been raped.

Bernard has a “memory lapse”
At the helm, this Wednesday morning, the young defendant evokes “a memory lapse” and claims to have no memory of the sexual assault. But he remembers what happened before the rape, and after when he woke up at the police station. Between these two moments, it’s a complete blackout.
For substitute Vervaeren, it is nothing more than a simple demonstration of what is called a “opportunistic memory.” “Heard right after the fact, he remembered he was in the hospital, he said he was looking for the exit and it was the victim who wanted it.” The fear of a possible recidivism not being excluded, the prosecution requires a firm sentence of 10 years in prison.
In the defense, we plead a last chance via a probationary stay. Bernard has already benefited twice from this preferential measure, in 2021. Two years later, the latter is at great risk on May 24.
