Trial Schedule and Legal Maneuvering
U.S. District Judge Alvin Hellerstein set the June 1, 2027, trial date during a hearing on Wednesday, July 22, 2026. The schedule was proposed jointly by federal prosecutors and the defense team, though Judge Hellerstein expressed skepticism regarding whether the parties could resolve complex issues surrounding classified information before the start date.
Maduro, 63, and Flores, 69, have been held at the Metropolitan Detention Center in Brooklyn since their capture. During the proceedings, Maduro appeared in court wearing tan prison attire. Observers noted that he appeared at ease, shaking hands with his attorneys and waving to the gallery. While he did not speak during the hearing, he previously entered a plea of not guilty to all charges, including conspiracy to import cocaine and weapons-related offenses.
Sovereign Immunity and Defense Challenges
Defense attorney Barry Pollack signaled his intent to challenge the government’s indictment on the grounds of sovereign immunity. Pollack argues that as the former head of a sovereign state, Maduro should be immune from prosecution in U.S. courts. The charges against the couple are part of a long-standing U.S. federal investigation. Prosecutors allege that Maduro utilized Venezuelan government and military officials to facilitate the movement of thousands of tons of cocaine into the United States. The indictment further accuses the leadership of coordinating with groups such as the FARC and the Sinaloa cartel, allegedly ordering acts of violence and murder to enforce their trafficking operations.
The U.S. government has maintained an antagonistic relationship with the Maduro administration for years. While the U.S. offered a reward of up to $15 million for his arrest in 2020—a figure that later climbed to $50 million—the current administration has defended the January 2026 raid as a surgical law enforcement operation.
