Watari issued a statement highlighting the infringements made by the Moroccan artist, Basma Bousil, on the rights to the song “Who Will Choose” by Hiba Tawaji, which Bousil had re-released in the form of a “cover”.

The company justified its decision to delete the song’s cover because it was published by Basma Bousil without mentioning the title of the original song, or even mentioning the names of the main rights holders, “in a clear violation of moral rights,” according to the company’s description.

In her statement, she said: “It should have been mentioned as follows.

And the company continued: “Basma Bousil attributed the musical production of the aforementioned work to another person, Jalal Fahmy, who has nothing to do with the basic version used (the master), which constitutes a clear and consistent infringement of literary and artistic property rights.”

The company mentioned Bousil’s use of this cover for the purpose of “promoting and marketing a commercial product, which inevitably leads to transforming the use of artwork into a purely commercial one, and constitutes an additional infringement of intellectual, literary and artistic property rights in accordance with laws and regulations, because this kind of commercial exploitation may only be done By obtaining the prior written consent of the rights holders, which is not available in our present case.

The company confirmed that Bousil had re-infringed on intellectual property rights by re-publishing the video clip through its account in the Instagram application after deleting it, without deleting the commercial advertisement and mentioning the names of the main rights holders, in a manner that includes clear mockery and incitement.

And she considered that it was more appropriate to smile back from the mistake by mentioning the rights holders within the video clip and by not using it to promote a consumer commercial product and without persevering in persisting in media misinformation, especially from the attempt of some misleading articles issued by one source with different names to promote the song as its first work. As if what happened constituted an infringement of her rights, while the reality is otherwise, as previously shown, which undoubtedly led to suspicion among some followers regarding the ownership of the rights belonging to that song.

Watari concluded its statement by emphasizing that the rights holders can deal positively with the issue by retracting the infringements of the aforementioned property rights, and publishing a correction by Basma Bousil on its own pages and not only on “Insta Story” as it previously did, as well as putting An end to the media misinformation resulting from the above, in order to avoid the rights holders taking the necessary administrative and judicial measures, in terms of addressing electronic applications and social networking sites officially through their legal agents to delete any illegal use of their rights, or in terms of resorting to the competent judiciary to preserve their rights with the consequences of that. of legal and material consequences.
