The independent unions met with ministers David Clarinval and Pierre-Yves Dermagne to discuss contract imbalances in mass distribution.
The Minister of Independents David Clarinval (MR) and his counterpart in charge of Economy and Labor Pierre-Yves Dermagne (PS) reiterated on Tuesday their desire toharmonize working conditions and commercial practices in the distribution sector, during a meeting with independent workers’ unions. They noted the grievances of the representatives of theMiddle Class Union (UCM) and its Flemish counterpart UnizoBuurtsuper and the Professional Association of Independent Food Self-Service.
“It will be necessary to better regulate certain practices in order to guarantee a balance between the commercial partners signing a franchise contract.”
As Delhaize prepares to franchise your own stores and that’Intermarché franchise of Mestdagh stores, David Clarinval announced that he will carry out an analysis of the different clauses included in the affiliation contracts. “If it appears that certain clauses are unfair, it will be appropriate to take measures to better regulate situations specific to commercial partnership contracts in food distribution… It will be necessary to better regulate certain practices in order to guarantee a balance between business partners signatories of a franchise contract”, commented the minister.
A draft bill to protect workers
For his part, the Minister of Economy and Labor recalled having presented to the social partners a draft bill intended for improve worker protection when a company is considering restructuring its business, both when it comes to massive layoffs and when it comes to outsourcing its activities. Criticizing the differences between joint committees which govern the sector, he considered unacceptable “that the practices of certain employers could lead to a leveling down of working conditions within the sector”.
Mr. Dermagne added that he would very soon formulate a proposal and possible solutions to the social partners.
