Department of Homeland Security Announces New Temporary Protected Status (TPS) for Venezuela 2023: Eligibility and Registration Information

The United States Department of Homeland Security (DHS) has announced a preview of the Federal Register notice separately extending and redesignating Venezuela for Temporary Protected Status (TPS), a document which will be officially published on October 3.

On the one hand, it is a 18-month extension of 2021 Venezuela TPS designationwhich takes effect from March 11, 2024 until September 10, 2025, a designation already announced by the Secretary of Homeland Security, Alejandro N. Mayorkas, on September 20, 2023, due to extraordinary and temporary conditions in this country that prevent people from returning safely.

On the other hand, the new notice explains how to register under this Venezuela 2023 redesignation, from October 3, and how to re-register for the Venezuela 2021 extension, from March 9.

All TPS applicants are eligible to apply for a Employment Authorization Document (EAD) for the duration of the TPS designation. Also, Travel authorization.

He new notice from the Federal Register explains all eligibility criteria, deadlines, and procedures necessary for current beneficiaries to re-register and renew EADs under TPS Venezuela 2021.

It also indicates all the requirements for new applicants to submit an initial application depending on each redesignation and request a work permit according to the TPS Venezuela 2023.

This redesignation of TPS for Venezuela allows additional Venezuelan citizens who have been continuously residing in the US since July 31, 2023, to apply for TPS for the first time during the initial registration period described. Also, people without nationality benefit who have habitually resided for the last time in Venezuela.

All Venezuelan citizens who arrived in the US before July 31, 2023, including that day, are eligible. DHS estimates that approximately 472,000 people may become eligible for TPS under the Venezuela 2023 redesignation.

Immigration authorities insist that those who do not enter through one of the many legal routes will be subject to law enforcement consequences.

Requirements and changes of the new TPS for Venezuela 2023

▪ Initial TPS applicants under this designation must demonstrate:

Continuous residence in the US since July 31, 2023. Meet other eligibility criteria. Physical presence in the US since October 3, 2023.

▪ Under the new redesignation of Venezuela 2023eligible Venezuelans applying for the first time and others who do not currently have TPS can file the Initial Form I-821, Application for Temporary Protected Status.

▪ The initial 18-month registration period begins October 3, 2023 and will remain in effect until April 2, 2025.

▪ These Venezuelans can request an Employment Authorization Document (EAD), related to the TPS, by presenting a Completed Form I-765, Application for Employment Authorization.

▪ They can apply for the employment permit at the same time as the TPS or separately later.

▪ If you are filing an initial TPS application, you must pay the Form I-821 fee or request a fee waiver when filing. Form I-912, Application for Fee Waiver.

Changes that affect TPS Venezuela 2021

▪ The extension of TPS Venezuela 2021, for Venezuelans who are already registered, has been extended from March 11, 2024 to September 10, 2025.

With this new extension, approximately 243,000 Venezuelans benefit from TPS until September 10, 2025, if they reregister and continue to meet the eligibility requirements.

▪ It is important that to keep the TPS Venezuela 2021 and work authorization in force, Venezuelans register in a timely manner during the 60-day registration period from January 10, 2024 to March 10, 2024.

▪ It is vital not to wait until the EAD expires. Delaying re-registration could result in gaps in your employment authorization documentation.

▪ DHS recognizes that not all re-registers may receive a new work permit before their current EAD expires, so it is automatically extending the validity of certain EADs previously issued under TPS Venezuela 2021 until March 10, 2025.

▪ The US Citizenship and Immigration Office (USCIS) continues to process pending applications submitted under the Venezuela TPS 2021.

Neither initial TPS applicants nor current beneficiaries who are re-registering and who have a Form I-821 or I-765 pending as of October 3, 2023 under TPS Venezuela 2021 need to submit a new application.

If USCIS approves an applicant’s pending Form I-821, it will grant TPS until September 10, 2025.

If USCIS approves a pending TPS-related Form I-765, it will issue the applicant a new work permit that will be valid until the same date.

▪ As proof of continued employment authorization through March 10, 2025, TPS recipients can show their EAD with the notation A-12 or C-19 under Category and a card expiration date of March 10, 2024 or September 9, 2022.

▪ The new TPS re-registration changes for Venezuela directly affect some Venezuelans who obtained TPS in 2022.

Reregistration under this notice applies to TPS beneficiaries whose reregistration application was approved under the TPS extension announced on September 8, 2022, who have been issued the Form I-797, Notice of Actionindicating approval of your application for TPS and an EAD, with an expiration date of March 10, 2024.

▪ Individuals with an EAD with an expiration date of March 10, 2024 who want to receive an EAD with an expiration date of September 10, 2025 must re-register according to the instructions in the federal register.

▪ If you apply to re-register for TPS, you do not need to pay the fee.

▪ If you show that you cannot pay for biometric services, you can ask to have the fee waived.

▪ You can resubmit an initial TPS registration application after receiving a denial of a fee waiver request.
