Investigation into Dysfunctions of Brussels Public Prosecutor’s Office and Handling of Abdesalem Lassoued Case: Recommendations for Improved Judicial System

Meeting this Monday, the Joint Advisory and Inquiry Commission of the Superior Council of Justice (CSJ) took the decision to launch a specific investigation into the functioning of the Brussels public prosecutor’s office in the handling of the Abdesalem Lassoued case. The attack that occurred last Monday – which left two people dead and one seriously injured – highlighted several flaws in the functioning of Belgian justice, particularly within the Brussels public prosecutor’s office. Dysfunctions which also pushed Vincent Van Quickenborne, then Minister of Justice, to resign.

“One of the roles of the CSJ consists of improving the functioning of justice for the benefit of the citizen, in particular through external control,” detailed the institution in a press release. The latter’s role is, in particular, to examine the dysfunctions of the judicial system. “Many events preceded this attack, including the circumstance that Abdesalem Lassoued’s case was not processed to its conclusion within the Brussels public prosecutor’s office,” commented the CSJ.

In view of the various information available, the assembled Advisory and Inquiry Commission decided, this Monday, to open a specific investigation into this matter. The latter will focus on “the functioning of the judicial system as well as the context and the elements which led to its dysfunction, and not on individual responsibilities,” said the High Council of Justice. At the end of the process, recommendations will be made so that such events cannot happen again.

This investigation is in addition to that launched internally at the Brussels Public Prosecutor’s Office. The latter having, through its Attorney General Johan Delmulle, announced on Sunday its desire to launch an analysis of work processes and human resources, but also a formal examination of “what exactly happened » in the follow-up to Abdesalem Lassoued’s case. Furthermore, the government has also called for an independent investigation by Committees P and R. For this last aspect, the ball is in the court of Parliament, which is competent to make the request.
