Members can sue California Fitness & Yoga for refunds

Members of the California Fitness & Yoga chain retain the full legal right to file civil lawsuits against the company and bypass mandatory arbitration clauses following widespread temporary gym closures. The National Competition Commission under the Ministry of Industry and Trade announced on November 4 that it had received numerous consumer complaints regarding suspended facilities and unfulfilled contract obligations.

The Legal Clash Over Dispute Resolution

The controversy centers on Article 21 of the California Fitness & Yoga Membership Manual, which mandates that disputes be settled via arbitration at the Vietnam International Arbitration Center (VIAC). Article 67, Clause 2 of the 2023 Law on Consumer Rights Protection overrides this constraint. The statute guarantees that when arbitration clauses appear in standard commercial transaction conditions, consumers maintain the legal freedom to select alternative dispute resolution methods.

Affected members can now initiate direct civil actions in competent courts. These proceedings target core contract execution, agreement termination, and the recovery of upfront service fees. Under Article 50, Clause 1, Point g of the consumer protection legislation, members can authorize social organizations dedicated to consumer rights to represent them in court proceedings.

Massive Branch Closures Strain Member Relations

The regulatory intervention follows an extensive wave of facility suspensions that left long-term prepaid subscribers without access to training spaces. All nine locations across Hanoi shuttered their doors, alongside branches in Nha Trang, Da Nang, and multiple sites within Ho Chi Minh City. By November 3, the temporary closure of the Aeon Mall Binh Tan branch reduced the active nationwide footprint to a single functional gym: Cali Binh Duong Square in Ho Chi Minh City.

California Fitness & Yoga announced plans to resume operations at two facilities in Vung Tau and Bien Hoa starting November 5. However, the company has yet to release a definitive reopening schedule for the remaining closed locations.

Required Documentation for Civil Claims

To prepare for upcoming legal filings, the National Competition Commission advised members to gather comprehensive documentation. Essential records include complete membership contracts, addendums, payment receipts, official corporate communications, proof of service delivery status, and copies of previous requests submitted directly to California Fitness & Yoga.

Whether individual members qualify for total contract dissolution, full refunds, or partial compensation depends entirely on judicial evaluation. Courts will assess each filed case independently under applicable civil and consumer protection statutes once formal petitions are accepted.
