A South Korean appellate court has upheld a 10-year prison sentence for a man in his 30s convicted of child abuse murder after he beat his three-month-old infant son to death. The ruling came down following an appeal centered on the severity of the punishment and claims of diminished capacity due to intoxication.
The Busan High Court’s Changwon branch, specifically Criminal Division 1 led by Presiding Judge Park Kwang-seo, dismissed the appeal filed by the defendant, identified only by his surname A. The court maintained the original 10-year prison term, alongside mandatory orders requiring the defendant to complete 40 hours of a child abuse treatment program and imposing a 10-year employment restriction at child-related facilities.
Events Leading to the Fatal Attack
The sequence of events began days before the fatal assault in Gimhae, South Gyeongsang Province. On November 22, the defendant argued with his wife, referred to as B, over economic pressures and alcohol-related friction. Following the dispute, the wife left the residence.
Investigations revealed that on November 23, the day before the crime, A dropped his infant son on the bathroom floor while attempting to wash him, failing to seek medical evaluation or take other protective measures afterward. Prompted by his wife’s departure, A subsequently invited a commercial sex worker into the family home to drink alcohol. Authorities established that A consumed approximately four bottles of soju and 1,500 milliliters of draft beer during this time.
After the visitor departed, the heavily intoxicated father attacked his three-month-old son, who was lying in an infant bed at around 2 a.m. on November 24. Law enforcement and judicial authorities concluded that the assault was fueled by mounting anger over marital discord and the stress of an unplanned pregnancy and childcare. A was also found to have harbored resentment regarding his wife’s opposition to his drinking habits.
The child’s mother returned home late on the night of the incident. The following morning, she fed the infant formula and placed him down to sleep before discovering he was unresponsive. She dialed 112 to report the emergency, and responders rushed the baby to a hospital, where he was pronounced dead.
Court Dismisses Intoxication and Intent Arguments
Throughout his initial trial, the defendant argued that he lacked any intent to commit murder and maintained that he was in a state of diminished mental capacity due to severe intoxication at the time of the offense. The first-instance court rejected both arguments, handing down the 10-year prison sentence.
Challenging that decision, A appealed the ruling on the grounds that the punishment was excessively harsh. The appellate judges, however, found no reason to alter the original judgment.
In its ruling, the second-instance court stated that the suffering experienced by the infant victim is beyond estimation and emphasized that the defendant turned the most vulnerable member of his home and society into a target for his displaced anger. The bench concluded that enforcing strict legal accountability was necessary.
