The bid for the seats in the Council of the Judiciary | What is at stake in the election of judges and lawyers?

On November 20, the Council of the Judiciary will have defined its new integration of 20 members instead of the 13 it had until now. This happens after the ruling of the Supreme Court of Justice that declared the 2006 reform unconstitutional and entered the Magistracy through the window designating the president of the Court himself as president. Last April, the Council underwent a temporary renewal, but now elections are being held to define the members for the next four years. All of them validated or will have to validate and renew their seats in elections by estates, except for the president of the Court, Horacio Rosatti, who will continue until the end of his term as president of the CSJN, and the representative of the Executive Power, Gerónimo Ustarroz.

Until now, the representatives of the universities and the right holders have already chosen their representatives: 2 representatives in total. Guillermo Tamarit, rector of the Northeast University, won unanimously by the teachers who took Pamela Tolosa, current counselor, as a substitute. For the universities, Hugo Galderisi, academic secretary of the National University of Lomas de Zamora, won. Two names that carry the name of Diego Molea behind them. This Tuesday judges and lawyers vote to elect 4 members per sector and in November it will be the turn of the election of senators and deputies, who must define 4 representatives per chamber.

Three lists compete for the election of lawyers: 1 “New Federal Lawyers” headed by María Fernanda Vázquez and Ignacio Segura; No. 2, “Commitment to the Constitution,” with Héctor Recalde and Adriana Coliqueo as the first candidates, and No. 3, “Advocacy for Judicial Independence,” which nominates Miguel Piedecasas and Jimena de la Torre. Behind list 1 is Diego Molea; behind list 2 the referents of the Frente de Todos and list 3 has in Piedecasas a favorite from the UCR and in Jimena de la Torre a former macrismo official who is a direct candidate, they say, of Mauricio Macri.

The Celeste list includes Judge Alberto Lugones and Pilar Rebaudi Basavilbaso and “Judicial Commitment” includes Eduardo Machín from the Court of Appeals of the Commercial jurisdiction -which the General Inspection of Justice (IGJ) denounced for systematically benefiting Mauricio Macri- -, and Alejandra Provitola.

The Council of the Judiciary has been virtually at a standstill since mid-July, awaiting this definition that will rearrange the majorities. Rosatti declared himself redundant but he was seen last week with Barroetaveaña in a photo first in Catamarca and then in La Rioja, during a Congress. Those who follow the rumors of corridors know that these are hours of tension. A definition that the elections will throw is if the Bordó List takes not only 1 or 2 places but up to 3 places. The same thing happens with the estate of lawyers where the Public Bar Association plays with the JxC list, and among the few certainties it is expected that the FdT list managed to get the chair of Héctor Recalde.

Judges and lawyers will vote from 9 a.m. to 6 p.m. in different authorized places throughout the country to elect their representatives for a period of four years, which begins next month. For the election of the four lawyers, the register has a total of 167,417 enabled, it is defined by the D’Hondt system and with gender parity and representation of the entire country.
