Venezuelan Prosecutor Challenges ICC Impartiality and Universal Reach: Saab’s Critique and Collaboration

In a recent statement, the Attorney General of Venezuela, Tarek William Saab, has expressed harsh criticism of the International Criminal Court (ICC), questioning its impartiality and universal reach. According to Saab, the ICC faces a huge challenge to convince the world of its objectivity, since only 123 countries have ratified the Rome Statute, which establishes the foundations of the international court.

The Venezuelan prosecutor pointed out that the United States has avoided submitting to the jurisdiction of the ICC, alleging that the country considers itself “the world’s gendarme” and will not allow a body outside its direct control to judge its military that intervenes in global conflicts. In addition, he mentioned that there are possible accusations of war crimes and crimes against humanity against US leaders and military, which has led the nation to pass laws to prevent ICC action against its citizens.

Saab also referenced Israel as the occupying power in Palestine and Syria, suggesting that his actions could make him a candidate for ICC indictment.

Despite these criticisms, the prosecutor affirmed that Venezuela will continue to collaborate with the ICC, showing respect for international justice. According to Saab, the country has provided the ICC Prosecutor with sufficient elements to show that human rights violations committed by police and military officials have been investigated and severely punished.

Regarding the ICC’s Office of Technical Cooperation (OCT), Saab stressed that it has not yet been installed, but expressed the hope of establishing a working relationship similar to the one they had with the Office of the United Nations High Commissioner for Human Rights after the visit of Michelle Bachelet in 2019. During that period, numerous cases suggested by Bachelet’s office related to deaths in protests, cruel and inhuman treatment and unlawful deprivations of liberty were pursued.
