International Drug Trafficking Case: Cacophony, Contradictions, and the Verdict

2024-01-16 11:54:00

A case full of contradictions and marked, at the hearing, by a certain cacophony with three interpreters (Dutch, English, Spanish), a cacophony maintained by defendants who believe themselves skilled or clever in asserting the opposite of what they declared during their hearings before being masterfully reframed by substitute Stéphanie Bonté to whom, to put it colloquially, “we don’t do it”.

In total, six defendants (including two absent) involved in a criminal association for the international transport of narcotics through companies between March 31, 2022 (date of the rental of a garage in Ophain-Bois-Seigneur-Isaac) and March 10, 2023, date of the arrest of Sameer Yusuf, 44, born in India, with no known address in Belgium, Gérard Gutierrez Palacios, a 34-year-old Spaniard with no address here, and Stéphane Ndenzako, born in Burundi in 1990 , domiciled in Geneva. They were in Brucargo in a car containing 15 kg of cocaine which was to be distributed God knows where.

The fourth defendant present at the hearing is Gerry De Cuyper, a 38-year-old resident of Bonheiden, sentenced in 2006 to four years in prison in Antwerp for drug trafficking linked to a criminal organization. The two absent are Jean-Michel Ndenzako, 35, who is believed to be in Burundi, and Guy Bodo, a 35-year-old Cameroonian living in La Louvière, sentenced to 37 months in prison on December 13, 2014 for violent theft.

Only beautiful people who, to hear them, were in or near companies that transported onions, beans or bananas from the Ophain garage. Except that, on March 10, 2023, a container leaving Belgium was examined by English customs: it contained 250 kg of ketamine (a fast-acting anesthetic) and 233 kg of cannabis, to which the Nivelles prosecutor’s office added the 15 kg of cocaine. from Brucargo.

English customs officers did not discover any document allowing them to identify the sender, but a telephone number appeared leading to Sameer Yusuf alias Tony, a colorful character who maintains two households in Spain, the mother of his two children and, in “extra”, the mother of Gérard Gutierrez Palacios to whom he boasted of winning gold in bar. For example €100,000 profit in seven months. He showered sumptuous gifts on the two Spanish women who actually know each other.

We will spare you the many incredible and often amusing assertions made by the defendants to arrive at the prison sentences required by Stéphanie Bonté who clearly did not see herself suddenly transformed into a market gardener presenting her onions, beans and bananas to her customers at the weekly market in Nivelles.

This therefore required: 8 years for the two alleged leaders of the criminal association Sameer Yusuf and Jean-Michel Ndenzako (with double fine of €240,000), 5 years for Gérard Gutierrez Palacios (fine of €80,000 including 20 000 € dry), 4 years and fine of 40,000 € for Guy Bodo, 20 months and fine of 80,000 € for Stéphane Ndenzako.

The lawyers will try to reduce the height of these sentences during an extraordinary hearing scheduled for this Thursday, January 18.
