MPE appeals to TSE against Ney Santos candidacy over criminal history

Ney Santos, whose career features past arrests and ongoing legal challenges, has won his legislative seat even as prosecutors argue he maintains ties to the Primeiro Comando da Capital (PCC) criminal organization. The outcome of his election remains contingent on a pending review by Brazil’s highest electoral court.

The controversy centers on accusations brought forward by the MPE (Ministério Público Eleitoral), which has formally requested the rejection of Santos’s candidacy registration. According to election prosecutors, the record details a history of serious offenses that demonstrate deep involvement in organized crime. TRE-SP Authorizes Santos Candidacy Despite Past Criminal Charges

Santos’s judicial record includes a past arrest in the act for bank robbery and a first-degree conviction, though he was later acquitted due to a lack of evidence. He also faced charges for crimes against the economic order and received a first-instance conviction for possessing a firearm with a defaced serial number. Despite these legal hurdles, the Regional Electoral Court of São Paulo (TRE-SP) authorized his candidacy on September 15 in a tight 3–2 vote.

Following the regional court’s approval, prosecutors appealed to the Superior Electoral Court (TSE). Minister Floriano de Azevedo Marques has been assigned as the case relator. When contacted by reporters regarding the allegations and the ongoing proceedings, Santos did not issue a statement.

TSE Review Could Strip Santos of Election Victory

The timeline for the final resolution now rests with the federal electoral bench. If the TSE accepts the MPE’s appeal and votes to bar the candidate, Santos’s registration will be denied retroactively, effectively stripping his election victory of any legal validity.
