Me Moussa Diop was placed under arrest warrant this Friday, December 15. The investigating judge of the second chamber of the Tribunal de Grande Instance (TGI) of Dakar, Mamadou Seck, did not dawdle with this case. However, Me Moussa Diop contacted the President of the Paris Bar to ask him to intervene in his case in the name of judicial cooperation between France and Senegal. He believes that these rights have been violated by the Senegalese justice system.

On the airwaves of the RFM, the professor of law and lawyer at the Paris bar, Samba Thiam, attests that the president of the Paris lawyers can intervene to find out the ins and outs of this case, but he specifies that Me Moussa Diop has made the remarks which earned him his detention in a political context and not under his lawyer’s hat.
“The rules which protect us require that we be questioned, worried during the exercise of our function as lawyers and that judicial cooperation respects one thing: the particular rules of each bar, each country has its sovereignty, lawyers are organized . The fact that I am a lawyer does not give me the possibility and total freedom to function as I want, as I do in the country where I am regularly registered and established as a lawyer,” he explains.

Faced with this situation, he informs that “the President of the Bar can inquire, can seek to find out what really happened. He can seek to know to what extent we can intervene in the name of the bar order to protect, respond to the help requested by this lawyer.
But in any case, we could oppose the fact that it was not Me Moussa Diop, as a lawyer who made his remarks but Me Moussa Diop, a politician, he whispers. “Yes, perfectly, because I said earlier that we are protected. You can request assistance when it concerns the exercise of your lawyer’s function. I assume you are a lawyer and you are on your lawyer duties. But if you exercise another function, during which you have had difficulties, it would be a little annoying to resort to the rules of the legal profession.”
