While Trump specified that the check would go to all adult citizens without exception, JD Vance, the evening of the Dallas event, offered a narrower interpretation. Vance described a dividend explicitly designed for workers and the middle class, which would exclude higher income brackets.

Further complications arise regarding eligibility and distribution mechanics. The restriction limiting the payout to “citizens” leaves out foreign residents holding green cards. Meanwhile, the mandate to spend the funds domestically creates logistical hurdles for American expatriates living abroad. Meanwhile, Treasury Secretary Scott Bessent told the House Financial Services Committee on Sept. 15 that methods exist to fund the initiative without driving up the national debt, though he declined to detail the mechanics, noting that the Treasury department remains in the planning stages.

Constitutional Limits and the Power of the Purse

Relying on tariff revenue faces significant judicial obstacles. The Supreme Court previously invalidated tariffs imposed under emergency economic powers legislation, forcing refunds to importers, while subsequent trade levies continue to face challenges in international trade courts.

Under the United States Constitution, the Treasury may only disburse funds explicitly appropriated by Congress. When questioned by CBS News about obtaining congressional approval following the Dallas rollout, Trump suggested that legislative authorization might not be necessary, asserting that Congress would ultimately comply if funding were required. Lawmakers on Capitol Hill maintain jurisdiction over federal spending.
